Mandating COVID-19 Vaccination for Employees

Over the course of the last few weeks, the FDA has granted Emergency Use Authorization for COVID-19 vaccines. These vaccines are expected to be widely available within the next few months.

Employers that are contemplating a vaccine mandate for all employees are strongly encouraged to consult legal counsel before taking action. While some employers may generally have the right to enact such mandates, there are exceptions that may come into play for employees with disabilities or employees with certain religious beliefs. Beyond these exceptions, there are collective bargaining considerations for employers with unionized workforces.
